The Technical University of Mombasa has sued the Football Kenya Federation chairman Sam Nyamweya, and other officers over the decision to ban the university's team from participating in the Division One league despite winning the 2012 South Coast provincial league.
The University, through a certificate of urgency, wants the High Court to quash the FKF decision to start both the Division One and Provincial league matches in South and North coast branches.
The applicant has listed the FKF league and competitions chairperson Dorris Petra, South Coast branch chair and its secretary general as the respondents in the suit.
In the application, the university sought to compel the respondents to rectify its records in relation to the Provincial league for the Coast branches to reflect them as the South Coast league champions in 2012.
The applicants through lawyer Charles Opulu, said the formerly known Mombasa Polytechnic FC were the duly qualified representatives of the Coast province after winning the South Coast provincial league.
The applicants said despite 43 clubs participating in the South Coast league no advise or letter has been received from the respondents that the champions of the league would not be recognised.
"The applicants won the South Coast mini league and were due to play their North-Coast counterparts on November 24 last year. They were supposed to be promoted but have been excluded," said Opulu.
Opulu said the football club had been complying with all the FKF provisions including payment of all registration and participation fees.
The applicants in their case said FKF decision was unjustifiable as it was illegal and unconstitutional.
