Two Teachers Jailed 35 Years Each for Defilement |
In her ruling, Mwondha said prosecution had adduced sufficient evidence pinning Everest Musinguzi, a teacher at St. Annex nursery and primary school in Nsambya sub-county, Kyankwanzi district and Jimmy Ssentubilo of St. Paul Kyamutwe primary school in Kiboga town over the crime of aggravated defilement.
Prosecution, led by Fred Mugisha, the Kiboga district State Attorney, said Musinguzi on June 22, 2012, dragged the 11-year-old victim into the school kitchen, where he defiled her.
Mugisha told court that Ssentubilo, who was entrusted with the responsibility of protecting and guiding a primary one pupil in his school, on April 11, 2007, overlooked all that and dragged her into the room he rented and defiled her.
The girl, now in Primary Seven at another school, told court that she often visited the teacher's daughter at their home. She added that on the fateful day, Ssentubilo called her to his room at around 7:30pm, forcefully removed her knickers and defiled her.
The victim said Ssentubilo told her not to tell anybody what had happened, but she was forced to share her ordeal with the relatives after the pain in her private parts became unbearable. The matter was reported to the Police. Medical reports were among the evidence tabled in court.
The accused pleaded for leniency, saying the devil was behind their actions and pledged not to repeat such a crime. But prosecution prayed for the maximum sentence because the teachers breached the professional code of conduct and their acts inflicted permanent trauma onto the victims.
Mwondha said the crime carried a maximum penalty of death, but because the teachers appeared repentant, she reduced the sentence to 35 years each in prison.
